1. Introduction and Agreement
These Terms of Use ("Terms") constitute a binding legal agreement between you ("User," "you") and Joris Dijkstra Software & Consultancy (trading as Dart Scores), located at Singelstraat 24, 3513BP, Utrecht, The Netherlands ("Company," "we," "us").
These Terms apply to (a) the Dart Scores mobile application (the "App") and (b) our online tournament management websites and related services that let organizers run events and let participants register and view tournament information (together with the App, the "Services"). By downloading, accessing, or using any part of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Age Restrictions and Eligibility
- 2.1 Strict 18+ Policy. Due to the real-time video and social interaction features, the App is strictly intended for users aged 18 years or older. By using the App, you represent and warrant that you are at least 18 years of age.
- 2.2 Minors. Use of the App by anyone under the age of 18 is prohibited. We reserve the right to request age verification and to terminate accounts or block devices if we suspect a user is a minor.
- 2.3 Tournament websites.If you use only our online tournament service (without the App), eligibility may also depend on the organizer's rules and applicable law for that event. Sections 2.1 and 2.2 apply in full when you use the App.
3. Anonymity, Accounts, and Device Identification
- 3.1 Account Types.You may use the App as an anonymous guest ("Guest User") or as a registered user ("Registered User") via third-party authentication (Google, Facebook, Apple).
- 3.2 Responsibility. You are responsible for all activity that occurs under your account or on your device.
- 3.3 Device-Level Enforcement. To ensure community safety and prevent ban evasion, you acknowledge and agree that we may use unique device identifiers (including but not limited to Apple DeviceCheck and Google Play Integrity API) to permanently ban a specific device from accessing the App if these Terms are violated, regardless of whether you are logged in or anonymous.
4. Online Gaming, Video Feed, and Social Features
- 4.1 The Service.The App facilitates dart scoring, statistics tracking, and online gameplay with real-time video feeds ("Online Services").
- 4.2 Content Moderation & Rolling Buffer.To ensure safety, we employ a "Rolling Buffer" technology:
- During a video call, the App temporarily stores the last 60 seconds of video/audio in your device's local memory (RAM).
- Under normal circumstances, this buffer is overwritten continuously and is not uploaded to our servers.
- If you report a user, or if you are reported, the data in the Rolling Buffer is immediately frozen, encrypted, and uploaded to our secure servers for review by our moderation team.
- By initiating or accepting a video game, you explicitly consent to this temporary buffering and the potential upload of the recording in the event of a safety report.
- 4.3 Zero Tolerance Policy. We have zero tolerance for objectionable content. You agree strictly NOT to:
- Transmit sexually explicit content, nudity, or pornography.
- Harass, bully, threaten, or defame other users.
- Engage in hate speech or discrimination.
- Cheat or manipulate game scores.
- 4.4 Enforcement (2-Strikes Rule).
- Violation 1: Temporary suspension (e.g., 30 days) from Online Services.
- Violation 2: Permanent ban from the App and Online Services.
- Immediate Ban: We reserve the right to permanently ban users immediately for severe violations (e.g., CSAM, severe threats) without a prior warning.
5. Subscriptions and Payments
- 5.1 In-App Purchases.Subscriptions ("Premium") are purchased through the Apple App Store or Google Play Store. These stores act as the Merchant of Record.
- 5.2 Automatic Renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period in your device settings.
- 5.3 Right of Withdrawal (EU Consumers). By purchasing a digital subscription, you expressly consent to the immediate commencement of the service and acknowledge that you thereby lose your right of withdrawal (the 14-day cooling-off period) once the contract has been fully performed or the digital content has been supplied.
- 5.4 Refunds. Refunds are handled exclusively by the respective App Store in accordance with their policies. The Company cannot directly issue refunds.
6. Intellectual Property
- 6.1 License. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
- 6.2 User Content. You retain ownership of content you post (e.g., profile photos, comments). You grant us a worldwide license to host and display this content within the App.
7. Disclaimers and Limitation of Liability
- 7.1 "As Is".The App is provided on an "as is" basis. We do not guarantee that the App will be error-free or uninterrupted.
- 7.2 Video Interactions. You acknowledge that real-time video interactions involve inherent risks. You interact with other users at your own risk. The Company is not liable for the conduct of any user on the platform.
- 7.3 Limitation.To the fullest extent permitted by law, the Company's liability is limited to the amount you paid to the Company in the six (6) months prior to the claim.
- 7.4 Tournament service.We are not liable for losses arising solely from an organizer's decisions, event cancellation, or disputes between participants and organizers, except where mandatory law provides otherwise.
8. Governing Law
These Terms are governed by the laws of The Netherlands. Any disputes shall be submitted to the competent court in Utrecht, The Netherlands.
9. Online tournament service (web)
The following provisions apply when you use our web-based tournament tools (for example to create or administer a tournament, or to register as a participant and use dashboards or schedules we host).
- 9.1 Our role. We provide software and hosting so organizers can run tournaments. We are not the organizer of your event unless we explicitly state otherwise. Tournament rules, pairings, results shown on screen, and communications about the event are primarily the responsibility of the tournament organizer.
- 9.2 Organizer accounts. If you create or manage tournaments on behalf of a club or event, you represent that you have authority to bind that entity where applicable. You are responsible for the accuracy of information you publish (names, dates, venues, fees communicated outside our checkout, etc.) and for using the Services lawfully.
- 9.3 Participant registration. When you register for a tournament through our platform, you understand that your registration data is processed to operate that tournament (including displaying information the organizer chooses to make public, such as draws or results). You must provide accurate information and comply with reasonable instructions from the organizer and with these Terms.
- 9.4 Payments on the tournament service. Unless we clearly state otherwise at checkout, participants do not pay a registration fee through our tournament platform. Optional paid capacity or related items for a tournament are purchased only by the tournament organizer (admin) account in the dashboard, under the prices and terms shown at purchase. - 9.5 Relationship between participants and organizers. Disputes about prizes, eligibility, conduct at the venue, or money handled directly between participants and organizers are between those parties. We may try to help with technical or account issues but we are not obliged to resolve private disputes between organizers and players.
- 9.6 Acceptable use.You must not use the tournament service to break the law, harass others, distribute malware, attempt unauthorized access to our or others' systems, or overload the Services. We may suspend or terminate access to the tournament service for violations.
- 9.7 Availability. We aim for reliable operation but do not guarantee uninterrupted access. Maintenance, outages, or third-party failures may affect live events; our liability is subject to Section 7.
